  1. Introduction

Welcome to HosterWise. By purchasing our packages, you agree to these general terms and conditions of sale. HosterWise offers are presented and billed as the sale of a digital product consisting of an access and usage license for a hosting environment configured for the client. Hosting is provided as an ancillary technical element to the license to enable the use of the product sold.

  1. Products Sold (Licenses + Hosting Included)

HosterWise markets packages (e.g., “Starter,” “Pro,” etc.) including: (i) the transfer of a non-exclusive, personal, and non-transferable access and usage license, granting access to a hosting environment configured by HosterWise for the duration specified in the order; (ii) the technical provision of this environment for the same duration. The client thus purchases a digital product (the access license) for which hosting is an ancillary technical means.

  1. Terms of Use and Access

Access to the environment requires being at least eighteen (18) years old and accepting these T The client is responsible for activities carried out via their credentials. License activation occurs upon HosterWise’s delivery of access (communication of credentials, going live, or equivalent event describing the start of access). All use must comply with applicable laws and this acceptable use policy.

  1. Domain registration

When you register a domain name via HosterWise, you provide accurate and up-to-date information. Domain registration is a customized product within the meaning of the Consumer Code; once registered, it is non-refundable. The domain can be managed as part of your access license.

  1. Intellectual Property

The product elements (codes, configurations, technical content, trademarks, logos, texts, images) are protected by intellectual property law and remain the property of HosterWise or its assigns. The access license grants a non-exclusive, personal, and non-transferable right of use, limited to the duration and purpose of the purchased offer.

  1. Acceptable Use

It is prohibited to use the access for: (a) illicit, harmful, defamatory, hateful, obscene content or activities, or those infringing on privacy; (b) infringement of third-party rights; (c) injection of viruses, malware, or any harmful code; (d) uses contrary to network security or integrity.

  1. Compensation

You will indemnify HosterWise against any claim resulting from your violation of these T or the use of access contrary to law or these conditions.

  1. Limitation of Liability

HosterWise shall not be held liable for indirect, special, or consequential damages related to the use of the license or the technical access provided. The client acknowledges that hosting is a technical accessory to the license sold.

  1. Modifications

HosterWise may adapt the T at any time. Continued use of the license/access after modification constitutes acceptance.

  1. Company Legal Information

WordPress Hoster, based in Olonne sur Mer, is a company registered in France. It is registered under the number RCS La Roche-sur-Yon A 799 325 949. The company’s VAT number is FR22799325949 and its SIRET number is 799 325 949.

  1. License Termination and Access Suspension

In case of serious breach (including violation of acceptable use, non-payment, fraud), HosterWise may terminate the license and/or suspend access without prior notice. The end of the purchased duration automatically extinguishes access rights, unless renewed by purchasing a new license period.

  1. Warranties and Representations

You warrant that you have the capacity to contract and comply with applicable regulations. You refrain from any use likely to incur HosterWise’s liability.

  1. Privacy

Your use is also governed by our Privacy Policy, incorporated by reference.

  1. Force Majeure

HosterWise shall not be liable for delays/failures due to external events (disasters, governmental acts, outages, attacks, strikes, etc.).

  1. Governing Law and Jurisdiction

These terms are governed by French law. Disputes will be resolved by the competent courts in France.

  1. Right of Withdrawal and Refunds

Consumers (B2C): In accordance with Articles L221-18 et seq. of the Consumer Code, you have a period of fourteen (14) days from the date of purchase to withdraw. However, for digital content not supplied on a tangible medium (the access license) whose performance begins before the end of the period with your express agreement and waiver of your right of withdrawal, no right of withdrawal applies upon activation of the license (delivery of access, going live, etc.). If you have not requested activation within 14 days, a full refund is possible within this period.

Professionals (B2B): Unless otherwise mandatorily provided, no right of withdrawal applies. Sales are final.

Domains: Once registered, domain names are customized, non-refundable products.

  1. Entire Agreement

These T, along with the policies published on this site, constitute the entire agreement between you and HosterWise and supersede all prior agreements.

Note: These T may be translated for your convenience. In case of divergence, the French version prevails.
